This Privacy Policy (“Policy”) outlines FLH Technologies Private Limited’s (“Flahy”, “we”, “our”, or “us”) practices concerning the storage, use, processing, and disclosure of personal data that (i) has been shared with us by you to avail and access the Software; or (ii) has been shared with us by Lab Partners with whom you have shared your personal data authorising them to access and use the Software on your behalf.

Please note that unless specifically defined in this Policy, capitalised terms shall have the same meaning as ascribed to them in our Terms and Conditions that are available at (https://flahyhealth.com/terms-condition) (“Terms”). Please read this Policy in consonance with the Terms.

At Flahy, we care about keeping your personal data safe and respecting your privacy. Please read this Policy carefully to understand how we handle personal data.

The Software can be accessed on Flahy's website (https://flahyhealth.com) or can be downloaded as an application that can be used to store existing digital data or digitise and store health or medical data and also allows you to receive Flahy's test reports. Where required under applicable laws, we only process your personal data based on the consent that you grant to us or Lab Partners (as the case may be).

2. THE DATA WE COLLECT ABOUT YOU

2.1

If you are an individual: We may process the following personal data about you:

  1. (a)Identity Data: This includes data such as your first and last name, email, date of birth, gender, title, address and identification documents.
  2. (b)Contact Data: This includes data such as your phone number, and email address.
  3. (c)Medical Data: This includes data such as your biological information, genetic information, pathology reports and other test reports and treatment plans.
  4. (d)Usage Data: This includes the data relating to how the Software is being used, for how long it is used, and when it is used.
2.2

If You are Staff of a Lab Partner: We may process the following personal data about you.

  1. (a)Identity Data: This includes data such as your first and last name, email, date of birth, gender, title, address and identification documents.
  2. (b)Contact Data: This includes data such as your phone number, and email address.
  3. (c)Usage Data: This includes the data relating to how the Software is being used, for how long it is used, and when it is used.

3. HOW WE COLLECT DATA ABOUT YOU

3.1

We use different methods to collect data from and about you including:

  1. (a)Direct Interactions: We collect data directly from you if and when you provide it to us to access or avail our Software, or through any other interaction with our team.
  2. (b)Information through Lab Partners: We receive your data from Lab Partners with whom you share your data to avail or to access and use the Software.
  3. (c)Automatic Technologies or Interactions: As you use, interact with, and navigate the Software, we will automatically collect data about your usage patterns. We collect this data by using server logs and other similar technologies.
  4. (d)Information we collect about you and your device: Each time you access our Software, we automatically collect computer metadata through the use of cookies and other similar technologies to provide, improve, and maintain the Software.

4. HOW WE USE YOUR PERSONAL DATA AND FOR WHAT PURPOSES

4.1

We will only use your personal data in accordance with applicable laws. Most commonly, we will use your personal data to provide you services in relation to the Software, to meet our contractual obligations with Lab Partners with whom you have shared your personal data, or where we need to comply with a legal obligation.

4.2

In general, we will not use or disclose personal data except in accordance with the following purposes or activities to:

  1. (a)perform our obligations with you in relation to the Software;
  2. (b)perform our obligations that arise out of the arrangement we have entered into with Lab Partners in connection with you;
  3. (c)administer and protect our business and the Software, including troubleshooting, data analysis, system testing, and performing internal operations;
  4. (d)monitor trends so we can improve the Software;
  5. (e)get appropriate regulatory approvals, research and development, improve our business and delivery models;
  6. (f)enforce our Terms;
  7. (g)respond to court orders, establish or exercise our legal rights, or defend ourselves against legal claims and detect, respond to and recover from cybersecurity incidents;
  8. (h)investigate, prevent, and take action against illegal or suspected fraud and conduct forensic audits;
  9. (i)address your grievances, feedback, or inquiries; or
  10. (j)ensure compliance with applicable laws.

5. SOFTWARE PROCESSING

5.1

If you are an individual, we process the personal data that you or Lab Partners choose to provide us to (i) enable your access to the Software by registering your profile with the Software; (ii) enable the use of a Software feature or for reporting a problem with the Software; and (iii) provide you with the diagnostic reports.

5.2

If you are a staff of Lab Partner, we process your personal data to (i) enable your access to the Software by registering your profile with the Software; and (ii) enable the use of a Software feature or for reporting a problem with the Software.

6. COOKIES

6.1

We automatically collect personal data including device and usage data through cookies and other similar technologies Cookies are small data files that are stored on your device. We use cookies and other tracking technologies to distinguish you from other individuals and to remember your preferences. This helps us provide you with a good experience and also allows us to improve the Software.

6.2

We identify you by way of using cookies. The cookies shall not provide access to data in your device such as email addresses or any other data that can be traced to you personally. The data collected by way of cookies will allow us to provide you with a tailored and user-friendly experience. The cookies shall enable access to certain features of the Software in connection with you. Most devices can be set to notify you when you receive a cookie or prevent cookies from being sent. If you prevent cookies from being sent, it may limit the functionality that we can provide on the Software in connection with you.

Additionally, you may encounter cookies or other similar technologies on certain pages of the Software that are placed by third parties. We do not control the use of cookies by such third parties.

7. HOW WE SHARE YOUR PERSONAL DATA

7.1

Your personal data may be shared by us with third parties including financial institutions, vendors, service providers, and business partners, for the purposes detailed in this Policy, or under your consent where required under applicable laws.

7.2

We may share data where we are required by law, any court, government agency, or authority to disclose such personal data. Such disclosures are made in good faith and belief that it is reasonably necessary to do so for enforcing this Policy or the Terms, or in order to comply with any applicable laws and regulations.

8. DATA SECURITY

8.1

We implement adequate security measures to protect your personal data from unauthorised access and such security measures are in compliance with the security practices and procedures as prescribed under applicable law.

9. DATA RETENTION AND DESTRUCTION

9.1

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation with respect to our relationship with you.

9.2

Upon completion of the retention period for each category of personal data as described above, we shall delete or destroy, to the extent technically possible, personal data in our possession or control, or render the personal data into anonymised data, so that it no longer constitutes personal data, in which case we may use this information indefinitely without further notice to you.

10. YOUR LEGAL RIGHTS

10.1

Under certain circumstances and subject to applicable laws and the Terms, you may have certain rights in respect of your personal data such as the right to review and correct your personal data, or revoke or deny consent.

10.2

If you wish to exercise any of the rights set out above, please write an email to the Grievance Officer, whose details are mentioned in Section 14 of this Policy.

11. CROSS-BORDER TRANSFERS OF PERSONAL DATA

11.1

The personal data that we process will be stored in India.

12. BUSINESS TRANSITIONS

12.1

You agree and acknowledge that in the event we go through a business transition, such as a merger, acquisition by another organisation, or sale of all or a portion of our assets, your personal data may be among the assets transferred.

13. CHANGE IN PRIVACY POLICY

13.1

We keep our Policy under regular review and may amend it from time to time, at our sole discretion.

13.2

The terms of this Policy may change and if they do, these changes will be posted on this page and, where required by applicable laws, notified to you.
